1. Who we are
Precision Bid Win is operated by Civil Vision Utilities ("we", "us"). By creating an account or using Precision Bid Win you are entering into an agreement with Civil Vision Utilities and agree to these terms. If you keep using the service, you accept any updated version of these terms.
2. The service
Precision Bid Win is software for heavy civil utility contractors. It reads construction drawings with AI, produces quantity takeoffs and cost estimates, and creates bid pricing sheets. You must be of legal age and, when using it for a company, have authority to bind that company.
3. Your account
Keep your login details confidential and your account information accurate. You are responsible for all activity under your account.
4. Acceptable use
- No unlawful, fraudulent or spam activity.
- No uploading content you don't have the rights to, or infringing anyone's intellectual property.
- No malware, probing, scraping, reverse engineering or getting around usage limits.
- No reselling or redistributing the service.
- No attempts to jailbreak or misuse the AI features, or to produce illegal or harmful content.
5. AI output and accuracy
AI takeoffs, quantities, prices and briefings may be inaccurate or incomplete. They are a starting point and do not replace professional judgement. You are responsible for checking every quantity and price before using it in a bid, and for having the rights to the drawings you upload. We may remove content or restrict output that breaks these terms. Rights-holders can report infringing content to us, and repeat infringers will lose access.
6. Your content
You own your drawings, projects and estimates. You give us a limited licence to store and process them only to provide the service. Outputs generated for you are yours to use.
7. Our intellectual property
Civil Vision Utilities owns the service, including its software, libraries, documentation and branding. We give you a limited, non-exclusive, non-transferable right to use it within the plan you bought.
8. Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal and cancellation terms are set out in Paddle's Buyer Terms. The annual plan renews every year until cancelled, and access continues until the end of the paid period. Refunded or disputed purchases remove the access they granted.
9. Service level
We work to keep Precision Bid Win available but don't guarantee it will be uninterrupted or error-free. The service is provided "as is", and to the fullest extent allowed by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
10. Liability
We are not liable for indirect or consequential losses, including lost profits, lost bids or lost data. Our total liability is limited to the fees you paid in the 12 months before the claim. Nothing here limits liability for fraud, death or personal injury where the law doesn't allow it.
11. Suspension and termination
We may suspend or end your access for a material breach, non-payment, security or fraud risk, or repeated violations of these terms. When access ends you can ask us to export your data within 30 days, after which it may be deleted.
12. General
These terms are governed by the laws of the State of New Mexico, USA, and disputes go to its courts. You may not transfer this agreement without our consent. Neither party is responsible for delays caused by events beyond reasonable control.
